Welcome to The Baja Western Onion Forums! By accessing he Baja Western Onion Forums (hereinafter "we", "us", "our", the Baja Western Onion Forums, "http://www.bajawesternonion.com/forums/"), you agree to be legally bound by the following terms. If you do not agree to be legally bound by all of the following terms then please do not access and/or use the Baja Western Onion Forums. We may change these at any time and we’ll do our utmost in informing you, though it would be prudent to review this regularly yourself as your continued usage of the Baja Western Onion Forums after changes mean you agree to be legally bound by these terms as they are updated and/or amended.
These Forums are intended to provide a discussion board for our local community in Baja California Sur, and are managed by the volunteer staff of The Baja Western Onion. These Forums are open to anyone, and anyone who cares to register and abide by The Baja Western Onion Forums Terms and Conditions may post messages here. Here you will find a community network of people helping people who share your interests in life in Baja California Sur. Post your questions and get answers here. Make your contribution by helping others who will benefit from your knowledge and experience.
BY REGISTERING AND BECOMING A MEMBER OF THE BAJA WESTERN ONION FORUMS COMMUNITY, AND/OR BY POSTING MESSAGES TO THE BAJA WESTERN ONION FORUMS, YOU CERTIFY AND AGREE THAT YOU HAVE READ AND AGREE TO ALL OF THE FOLLOWING TERMS AND CONDITIONS GOVERNING THE BAJA WESTERN ONION FORUMS:
ACCEPTABLE USE
You may use The Baja Western Onion Forums, subject to all of the guidelines contained herein. You agree to abide by all The Baja Western Onion Forums Message Board Rules and TERMS AND CONDITIONS, present and future, which may be subject to change at any time.
Violations may lead to you being immediately and permanently banned, with notification of your Internet Service Provider if deemed required by us. The IP address of all posts are recorded to aid in enforcing these conditions. You agree that The Baja Western Onion Forums has the right to remove, edit, move or close any topic at any time should we see fit. As a user you agree to any information you have entered to being stored in a database. While this information will not be disclosed to any third party without your consent, The Baja Western Onion Forums shall not be held responsible for any hacking attempt that may lead to the data being compromised.
By posting on The Baja Western Onion Forums you agree to NOT to use The Baja Western Onion Forums to:
- Upload, post, email or otherwise make available or transmit any Content that is unlawful, harmful, libelous, defamatory, threatening, abusive, harassing, invasive of another’s privacy, obscene, vulgar, sexually-orientated, hateful, or racially, ethnically or otherwise objectionable material, or any material that may violate any laws be it of your country, the country where "The Baja1 Forums" is hosted or International Law;
- Harm, intimidate, coerce, or solicit minors in any way;
- Impersonate, or falsely state or otherwise misrepresent your affiliation with, any person or entity, including, but not limited to, a Baja Western Onion Forums official, forum leader, guide or host;
- Forge headers or otherwise manipulate identifying information in order to disguise and/or with the effect of disguising the origin of any Content transmitted through the Baja Western Onion Forum;
- Upload, post, email or otherwise make available or transmit any Content that you do not have a right to transmit under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under non disclosure agreements);
- Upload, post, email or otherwise make available or transmit any Content that infringes any patent, trademark, trade secret, copyright or other proprietary rights ("Rights") of any party;
- Upload, post, email or otherwise make available or transmit any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation;
upload, post, email or otherwise make available or transmit any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
- Disrupt the normal flow of dialogue, or otherwise act in a manner that negatively affects other users’ ability to engage in Forum exchanges;
interfere with or disrupt The Baja Western Onion Forums or another person’s use of The Baja Western Onion Forums or servers or networks connected to The Baja Western Onion Forums, or disobey any requirements, procedures, policies or regulations of networks connected to The Baja Western Onion Forums;
- Intentionally or unintentionally violate any applicable law, statute, regulation, rule or code, including, but not limited to, any regulations or rules of any regulatory body, governmental agency or national or other securities exchange;
- "Stalk" or otherwise harass any other Forum User; or
- Collect or store personal data about any other Forum User.
REGISTRATION
Registration is required to post new topics or reply to existing topics on The Baja Western Onion Forums. Registration is free, and you are not required to post your real name. You are required to register your actual e mail address, however. This information is necessary to send you information about the Forums or to retrieve a lost password. You are under no obligation, though, to make your e mail address visible in your profile. Your e mail address is visible to but it will not be disclosed to others.
REGISTRATION BY CHILDREN UNDER THE AGE OF 13
Registration by children under the age of 13 is permitted, but only under the requirement that you obtain permission from a parent or legal Guardian to do so. Such permission must be provided in writing to the Forums Administrator, and contain the name(s) and contact information for your parent or Legal Guardian.
COURTESY AND GENERAL CONDUCT
In keeping with the cooperative spirit of The Baja Western Onion Forums, all members are expected and required to conduct themselves in a helpful, courteous, polite and adult manner.
The Baja Western Onion Forums are rated "G" for use by all family members. All users shall refrain from the use or posting of objectionable materials, profanity or expletives, or chauvinistic, harassing, violent, hateful, sexual or pornographic content or innuendo, racial or ethnic slurs or humor, racist or politically extreme views or remarks, or anything that might be deemed in any manner to be illegal, insulting, demeaning or offensive by any identifiable social, religious, ethnic or racial group, or gender.
PERSONAL DISPUTES
It is perfectly permissible to debate issues of general interest regarding Baja Western Onion information and topics. It is also permissible to correct inaccurate information that has been posted by others. However, posting or airing of personal disputes and attacks over issues between Members of The Baja Western Onion Forums are specifically prohibited. Do not engage in such disputes. Instead, please report any violations to The Baja Western Onion Forums Moderator(s) or to the Forums Administrator.
FLAMING
"Flaming" other Baja Western Onion Forums Members, that is attacking, harassing, provoking, inciting, goading or intimidating other Members by posting derogatory, insulting or provocative remarks, comments, "name calling" or innuendo, whether personal or otherwise, will not be tolerated. Do not engage in such behavior. Instead, please report any violations immediately to The Baja Western Onion Forums Moderator(s) or to the Forums Administrator.
FLAME WARS
ALL Baja Western Onion Forums Members who engage in "Flame Wars" on The Baja Western Onion Forums may be suspended or permanently banned, regardless of who started the Flame. If you feel someone has flamed you on The Baja Western Onion Forums, do not respond in kind. Instead, please report any violations immediately to The Baja Western Onion Forums Moderator(s) or to the Forums Administrator.
MULTIPLE USER NAMES
Registering and posting messages on The Baja Western Onion Forums using multiple user names is permitted as long as this is not done with the intent to deceive others into thinking that these user names, and their posts, belong to different people. Also, such activity is not tolerated where a user assumes multiple identities in an attempt to support or defend their opinions or attacks on others. Please report any suspected violations to the Forums Administrator.
COMMERCIAL MESSAGES
You may post commercial messages in the appropriate Forums. If you wish to advertise here on the Baja Western Onion web site, please contact for advertising rates and availability. Please report any inappropriate commercial posts immediately to The Baja Western Onion Forums Moderator(s) or to the Forums Administrator.
SPAM
SPAM is defined as the sending of Unsolicited Commercial E mail or the posting of self-serving or commercial messages, or political statements in one or more Forums. No one may use The Baja Western Onion Forums to SPAM other members, either inside or outside of The Baja Western Onion Forums. You may not post messages or harvest Members’ E mail addresses with the intent to send Baja Western Onion Forums Members SPAM. Please report any violations immediately to The Baja Western Onion Forums Moderator(s) or to the Forums Administrator.
EDITING YOUR OWN POSTS
Editing of your own posts is currently enabled, except in any Forum where this is found to be a problem. You may also post a follow up retraction or clarification to a previous post. If you need your original post deleted, contact The Baja Western Onion Forums Moderator(s) or to the Forums Administrator.
ADDING SIGNATURES
Other than your name and basic information, we discourage the use of lengthy signatures on posts in The Baja Western Onion Forums. Your personal information is in your Profile and our Members can locate it there. The Forum threads become almost unreadable when signatures are used, and many contain commercial content (which is prohibited).
ATTACHING FILES
You may not attach files, other than image files, to any posts in The Baja Western Onion Forums. You can attach links to personal pictures on other web sites (if enabled), subject to all other guidelines, and you may cut and paste text into your post, or use "PHPbb Code" and HTML (if enabled) to provide hyperlinks to outside documents or files, as long as these outside documents or files conform to all of the Guidelines of this Forum, especially including the following:
LINKS
You may not post links to objectionable or illegal sites, documents, materials, images, viruses, spy ware, pirated software, or other such contraband, or to self-serving promotional material or sites. Please report any violations immediately to The Baja Western Onion Forums Moderator(s) or to the Forums Administrator.
FORUM MODERATORS
The Baja Western Onion Forums Moderators monitor and control individual forums. They can edit, delete, or prune any posts in their forums. All Members are expected to respect the authority of the Forum Moderators at all times. Disrespecting the authority of any Moderator is grounds for suspension from these Forums. If you have a question about a particular Forum, you should direct it to your Forum Moderator. If you would like to become a Moderator, please contact the Forums Administrator.
ADMINISTRATORS
The Forum Administrator is responsible for, and maintains and supports, The Baja Western Onion Forums and the Forum Moderators. can edit, delete, or prune any posts in any Forum, and they may override actions taken by Moderators. All Members are expected to respect the authority of the Forum Administrator at all times. Disrespecting the authority of the Forum Administrator is grounds for suspension from these Forums.
The Forum Administrator may also suspend Moderators if such action is warranted. If you have a question about a particular Baja Western Onion Forum, you should direct it to your Forum Moderator. If you have a suggestion for the Forums or a problem with a Moderator, please contact the Forums Administrator.
CENSORING POSTS
has the ability to censor certain words that may be posted. This censoring is not an exact science, however, so certain words may be censored out of context. Please realize that the censoring, if any censoring is being performed, is being done by a computer based on words, or portions of words, that are being screened. Words that are censored are replaced with asterisks (*******). Also, and Moderators have the power to modify or delete posts that are deemed in violation of any of The Baja Western Onion Forums Terms and Conditions.
DELETING POSTS
Threads carried on The Baja Western Onion Forums will vary over time. We reserve the right to delete threads or parts thereof, as we determine necessary, on a routine basis. Typically, The Baja Western Onion Forums is periodically policed and we try to stay with the conventional wisdom about the right to exist for a thread or parts thereof. The content of all threads is provided by and is the responsibility of the creator of that thread or the person posting an article. The Forums Administrator and Moderators have the power to modify or delete posts that are deemed in violation of any of these Guidelines.
FREE SPEECH
Free Speech is the right to express one’s opinion in the public domain, within reasonable bounds. This US Constitutional guarantee DOES NOT cover or allow The Baja Western Onion Forums Members to right to say or do anything they want in The Baja Western Onion Forums without being subject to editing, deletion or expulsion by The Baja Western Onion Forums Moderators or the Forums Administrator.
Although made available to the general online public, The Baja Western Onion Forums are a private concern paid for and maintained by the volunteer efforts of the Forums Administrator. As such, Baja Western Onion Forums Members do not have a Constitutional "right" to post anything they wish here, any more than they have a Constitutional right to spray graffiti on someone’s private residence, or shout "Fire!" in a crowded theater.
Members who do not understand this distinction are invited to expend the considerable time and effort it takes to start and run their own web site and Forums.
NOTICE OF NON LIABILITY
Notwithstanding any of the guidelines herein, you agree hold harmless from liability The Baja Western Onion Forums, the Members, the Administrators and Moderators of The Baja Western Onion Forums, and the owner or webmaster of the web site domain name, BajaWesternOnion.com, from any direct or indirect civil or criminal prosecution, defamation, loss of property, injuries or damages, real or imagined, you feel you may have sustained through the use of or participation in The Baja Western Onion Forums, or from any content contained herein.

SUSPENSION AND FINAL AUTHORITY
Members of The Baja Western Onion Forums who violate any of the above guidelines, or who commit other as-yet-undefined offenses, will be warned, and repeated violations will result in suspension of membership. In the case of flagrant or serious violations, the offending Member of The Baja Western Onion Forums may be immediately suspended without warning. will be the sole and final judge and arbitrator of any decision or dispute, and his/her decision and/or actions will be final.
CHANGES TO THE BAJA WESTERN ONION FORUMS TERMS AND CONDITIONS
The Baja Western Onion Forums Terms and Conditions may be amended from time to time as conditions require, and determination of inappropriate Member conduct, and any consequent actions taken, shall be the sole prerogative and decision of the Forums Administrator. You agree that your continued use of The Baja Western Onion Forums before and after any such amendment will constitute your acceptance of and agreement to be bound by the modified Terms and Conditions.
